These Terms and Conditions govern the provision of home repair, renovation, and maintenance services by Ost Repair Tool Box ("we", "the Company"), Bo. Bellavista, 45, 39012 Santander, Cantabria, Spain. By accepting a written quotation or instructing us to proceed with any work, you agree to these terms.
We provide home and apartment repair, renovation, plumbing, electrical, painting, flooring, and maintenance services as described in the written quotation issued to you. Any additional work outside the scope of the agreed quotation must be authorised by you in writing before it is undertaken, and will be priced accordingly.
All quotations are provided in writing and remain valid for 30 days from the date of issue. Quotations are based on the information available at the time of assessment. If concealed conditions (such as structural defects discovered when opening walls, or pre-existing plumbing defects) materially affect the scope of work, we will notify you in writing before proceeding with any additional work and its associated cost.
Prices quoted are inclusive of labour and any materials specified in the quotation. Materials not specified are not included. VAT (IVA) is charged at the applicable Spanish rate and will be shown on invoices.
For projects under €1,000: payment in full on completion of the work.
For projects between €1,000 and €5,000: 30% deposit on instruction, balance on completion.
For projects over €5,000: a payment schedule tied to project milestones, as specified in the written contract.
Invoices are due within 14 days of issue. Late payments may incur interest at the statutory Spanish commercial rate under Law 3/2004 on combating late payment.
You are responsible for: providing access to the property at agreed times; ensuring that the work area is clear of personal belongings before work begins; informing us of any known hazards at the property (including asbestos, lead paint, structural weaknesses, or concealed services); and obtaining any permissions or consents required from your landlord, building community (comunidad de propietarios), or local authority before work begins.
We provide a minimum 12-month workmanship guarantee on all completed work. This covers defects arising from our workmanship during the guarantee period. It does not cover fair wear and tear, damage caused by misuse or accident, or defects caused by pre-existing conditions not disclosed at the time of instruction. Materials are covered by the manufacturer's warranty where applicable. The guarantee does not affect your statutory rights under Spanish and EU consumer law.
Our liability for any claim arising from the provision of services is limited to the total value of the work carried out under the relevant contract. We are not liable for indirect or consequential losses, including loss of income, loss of use of the property, or costs incurred through delay unless caused by our negligence. Nothing in these terms limits our liability for personal injury caused by our negligence or for fraud.
We hold professional liability insurance covering our operations. Details are available on request.
You may cancel an instruction at any time before work begins. If you cancel after work has started, you are liable for the cost of work completed to that point and any materials ordered specifically for your project that cannot be returned. We may cancel our instruction if site conditions make it unsafe to proceed, or if access is denied at the agreed time. We will give reasonable notice where possible.
We are committed to resolving any disputes quickly and fairly. If you have a concern about the work carried out, please contact us in writing at [email protected]. We will respond within 5 business days. If a resolution cannot be reached, disputes are subject to the jurisdiction of the courts of Santander, Spain, and governed by Spanish law.
Your statutory rights as a consumer under Spanish law (Real Decreto Legislativo 1/2007 and related legislation) and EU consumer protection directives are not affected by these terms. If you are contracting as a consumer, you have the right to an itemised written quote before work begins, the right to information about the identity of our tradespeople, and the right to transparent pricing without hidden charges.
These Terms and Conditions are governed by and construed in accordance with the laws of Spain. Any disputes arising under them are subject to the jurisdiction of the courts of Santander, Cantabria.
